These Terms of Service are an agreement between you and RoboRoxy. This agreement sets forth the general terms and conditions of your use of our products and services within the website.
It is your responsibility to provide accurate and complete information on registration forms. Providing an email address that is different from the domain you are signing up under is a must. We are not responsible for any lapse in the services, including without limitation, any lapsed domain registrations due to outdated contact information being associated with the domain. Please contact our support team via tickets or update your contact information through your account area whenever needed. Providing false contact information of any kind may result in the termination of your account. You agree to be fully responsible for all use of your account and for any actions that take place through your account. It is your responsibility to maintain the confidentiality of your password and other information related to the security of your account.
Your use of the Services is at your sole risk. It is your responsibility maintain the security of the services you use and take backups. You should not rely on RoboRoxy for backups. RoboRoxy is not responsible for files and/or data residing on your account.
RoboRoxy offers multiple flexible bandwidth packages on all web hosting and service plans. The bandwidth is calculated 50/50 between inbound and outbound usage. Usage levels over your included bandwidth are billed monthly at the rate of $0.50 per GB. If you exceed or are about to exceed your monthly allotted bandwidth during any billing cycle, we reserve the right to limit network access, bill for estimated overage in advance, or suspend service until payment for the bandwidth overage is completed.
No account, server, or service may consistently consume more than 10 % of the resources in total available such as CPU utilization, Disk space, Disk I/O, Memory, web port connections, network bandwidth or network packets per second over a sustained period. Any web hosting plan may not run daemons or back ground tasks. Web hosting Accounts may not use the server disk space for storage of backups, file sharing, file storage, and/or any type of content that is not accessible on the web site you are hosting. Any violations to this policy in any manner may be suspended and/or backups/hosted data removed without notice.
Users found to be exceeding usage limits, RoboRoxy may, without prior notice or warning, limit access, suspend or terminate the service or account at RoboRoxy's sole discretion.
Any customer with more than 5 (five) verified abuse complaints in a given month is charged a service fee of $50/complaint. Abuse complaints are defined as documented issues that are confirmed violations of these terms of service and to be a result of customer, or customer's, web hosted content or information. A service fee of $125/hour will apply for investigation and corrective work performed by RoboRoxy to resolve SPAM violations.
If, as a result of a Customer's actions, RoboRoxy's mail servers or IP address ranges are placed on email black hole lists or other mail filtering software system list, RoboRoxy shall charge the Customer $250 upfront and $125/hour thereafter for any necessary investigation and corrective work.
You agree to pay for the Products and Services on time and in advance for the billing cycle Services are provided for. Invoices are generated 14 days prior to the renew date of Hosting services and 30 days prior to domain renewal. Failure to pay any invoice could lead to suspension of all services until the account is paid and current. A late fee of 3% will be applied over 5 days past due.
Payments are only accepted as Credit/Debit Cards and has to be paid in U.S. currency.
Any orders that have utilized a license for which RoboRoxy has paid fees to a third party - such as (but not limited to) Microsoft Licenses, cPanel Licenses - are non-refundable. Payments for domain names, for which RoboRoxy pays to a registrar, are also non-refundable. Our refund policy refers to the new clients only. Existing clients will not receive refund for the new orders. We would be happy to provide you with a full refund within your first 15 days of purchase for shared hosting with at-least 1 year purchase period.
RoboRoxy offers and may offer in future certain third party products and services. Such products and services may be subject to the terms and conditions of the third party provider. You should confirm the terms of any purchase and the use of goods or services with the specific third party provider with whom you are dealing.
RoboRoxy does not make any representations or warranties regarding, and is not liable for, the quality, availability, or timeliness of goods or services provided by a third party provider. You undertake all transactions with these third party providers at your own risk. We do not warrant the accuracy or completeness of any information regarding third party providers. RoboRoxy is not an agent, representative, trustee or fiduciary of you or the third party provider in any transaction.
Any new software development, modification / improvement to an existing software that you request from RoboRoxy has to be informed in written communication even though you might have requested vocally over the phone before.
Any new software development, modification / improvement to an existing software costs $5.50/hour and $40.00/day. When it reaches 8 hours, it will be considered as a day and daily rate will be applied.
RoboRoxy may without advance notice change this agreement from time to time, and will do so by posting the new agreement on the RoboRoxy web site in place of the old. You agree to visit the Terms And Conditions regularly for updates.
